Privacy Policy

This Privacy Policy describes how Amy Van Ness, d/b/a The Amy Plan ("The Amy Plan," "we," "us," "our") collects, uses, and shares your personal information in connection with our travel planning and advisory services. This Policy is incorporated by reference into The Amy Plan's Terms and Conditions.

Information We Collect

In the course of planning and booking your trip, we collect information you provide directly, including:

  • Your name, contact information (email, phone, mailing address), and travel preferences

  • Passport information, required before booking any travel, as described in our Terms and Conditions

  • Payment card information, submitted via a credit card authorization form, used to pay Travellustre and/or Suppliers on your behalf for the cost of your trip

  • Planning fee payment information, processed separately through Stripe; The Amy Plan does not receive or store this payment information

  • Information about other travelers in your Group, Coordinated Group Trip, or Amy Plan - Organized Group Trip, to the extent needed to complete their travel arrangements

If The Amy Plan's website or booking portal uses cookies, web beacons, log files, or similar tracking technology, we automatically collect information about your interaction with the site, including usage details, IP address, browser type, access times, and the pages or content you view. You may refuse cookies through your browser settings, though this may limit your ability to use parts of the site.

How We Use Your Information

We use your information to design your itinerary, make and manage bookings on your behalf, communicate with you about your trip, comply with Supplier and government documentation requirements, and process payment for our own planning fees and for your trip costs. We may also use your information to send you marketing communications about The Amy Plan's services, which you may opt out of at any time as described below.

Who We Share Your Information With

We share your information with Travellustre, our host travel agency, and with the Suppliers (airlines, hotels, cruise lines, tour operators, and other vendors) involved in your itinerary, as necessary to complete your bookings. We share planning fee payment information with Stripe, our payment processor for that purpose only.

We may also share your information with other third-party service providers who perform functions on our behalf, such as an email marketing platform, bookkeeping or accounting services, and vendors coordinated for a special event, such as a photographer, florist, or caterer. These providers are authorized to use your information only as needed to perform their function for The Amy Plan and are not authorized to use or disclose it for any other purpose.

Once you book travel with a Supplier, your information is also subject to that Supplier's own privacy policy, and it is your responsibility to understand its terms.

We do not sell your personal information. We may disclose your information (i) if required by law, regulation, or legal process, (ii) in response to a request by a government or law enforcement agency, (iii) in connection with establishing, exercising, or defending our legal rights, or (iv) if we believe disclosure is necessary to prevent physical harm, financial loss, or in connection with an investigation of suspected illegal activity.

Payment Information Security

Payment card information you provide for the cost of your trip is collected through a secure credit card authorization form. Providing this authorization is your agreement that The Amy Plan and/or the applicable Supplier may charge your card for your trip, and is your acknowledgment and agreement to The Amy Plan's Terms and Conditions, including the cancellation terms described there. When booking your trip, we pay Travellustre and/or the applicable Supplier directly, and you may incur additional fees based on their own terms and conditions; some Suppliers do not accept all credit cards. Planning fee payments are processed separately through Stripe and are not stored by The Amy Plan.

Targeted Advertising

The Amy Plan uses your information to provide targeted advertising or marketing you may be interested in. You may opt out of ad targeting through the following:

Opting out of targeted advertising does not stop online advertising altogether, only advertising tailored to your interests.

Do Not Track

Some browsers offer a "Do Not Track" signal. The Amy Plan's website does not currently alter its data collection practices in response to Do Not Track signals; if you do not wish to participate in preference-based advertising, use the opt-out links above instead.

International Data Transfers

Most of The Amy Plan's Suppliers are located outside the United States. When you book travel through The Amy Plan, your information is transferred to Suppliers and other parties in the destination country or countries as necessary to complete your booking. Those countries may not have the same data protection laws as the United States. We take reasonable steps to protect your information consistent with this Policy in any such transfer, but once your information is provided to a Supplier, that Supplier's own privacy practices and local law govern its further use.

Notice to California Residents

California residents have the right to request access to, correction of, or deletion of the personal information we hold about them, subject to certain exceptions. To make such a request, contact us using the information below.

Notice to European Residents

If you are a resident of the European Economic Area, you have the right to access, correct, update, or request deletion of your personal information. We process your information to fulfill our contract with you or to pursue our legitimate business interests described in this Policy. Your information may be transferred outside the European Economic Area, including to the United States.

Data Retention

The Amy Plan retains client information indefinitely, to provide continuity of service for your future travel planning, unless you ask us to delete your information as described in the Your Choices section below. Payment card information is the exception: we do not retain full card numbers beyond what is needed to complete your transaction and any applicable dispute or chargeback window, after which it is securely destroyed.

Children's Information

We do not knowingly collect information directly from minors. If you provide information about a minor traveling with your Group, you represent that you are their parent or legal guardian, or are otherwise authorized to provide that information on their behalf.

Your Choices

You may ask us to correct inaccurate information we hold about you, or to delete information we hold about you, subject to the exceptions described in the California and European resident sections above. Unless you ask us not to, we may contact you about specials, new services, or changes to this Policy; you may opt out of any future marketing contact from us at any time. This does not affect communications necessary to complete an active booking.

Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be provided to you and is effective immediately upon posting or delivery.
